In a truly twisted turn to this saga, the Deputy President demonstrated that she is willing to accept the evidence of the good Qantas Doc, but that even if my client files expert evidence to dispute the findings of Prasad that the Commission will NEVER EVER EVER EVER CONSIDER the evidence. The reason for this… drum roll please…back in 2021 with the Mt Arthur Coal decision, the Fair Work decided that all the science was settled with these death jabs and there was no more opportunity EVER EVER EVER to question the science. Even though a different Deputy President in another engineer case in the Tween decision, again with over 30 years experience, just before hearing my client McFall’s case, heard the same Prasad evidence and determined that unless that science is challenged all engineers working in hangars are destined to lose.
So like a good gal rep, I sought to improve my client’s case by challenging the good Dr’s evidence!
But to no avail. Instead, we get this fantastic decision showing and proving the corruption of the Commission in that they will allow Qantas to present their expert evidence because it confirms the settled science but my client was denied even the opportunity to garner expert evidence in response ???? And he was then threatened with non-compliance orders unless he attends the hearing knowing that he is NOT prepared! Denial of natural justice and procedural fairness anyone????
The Deputy President put it in writing. The decision shows my extremely (drum roll please) logical request and I must say clear explanations.
The brave McFall wants to challenge this in the Federal Court. He does not want to challenge Qantas anymore but the corrupt Commission itself for aiding and abetting these employers in legitimising their flawed and fraudulent policies and denying all applicants at the Fair Work the chance to challenge the science justifying the death jab policies!
How can it be fair that Qantas is allowed their experts and their evidence to be heard but applicants are denied the opportunity to even file expert reply evidence and then be told that even if they do, the Commission has already decided that the death jabs are gifts from the Gods?
Bring it on we say! So glad we have this written decision to show and prove the corruption.
