Part 4: The Deputy President (DP) says she will completely accept the evidence of Dr Prasad as independent medical evidence when the good doc is employed directly by Qantas. I thought Prasad was irrelevant DP? And my client never said that the good doc was not qualified, he just said ummm he was not independent cause Qantas pays him…In any case, the DP after saying the Prasad evidence was not relevant has later accepted it as relevant and in the same breath denied McFall the right for more time to garner expert evidence and even if he did, pre-decided that that evidence will not even be considered.
So when a court or commission or tribunal member, magistrate, commissioner, deputy president, judge- I honesty don’t care what they call themselves anymore- starts to tell you that they will never consider any additional evidence (medical or otherwise) than you know you are experiencing kangaroo justice ?
If the objective of a court is truth finding, then doors must never be closed on new evidence irrespective. The very fact you are told that the Respondent employer is allowed to put on their evidence because it supports the party line and your evidence will not even be allowed to be procured let alone considered then you know the hearing will be a complete stitch up!
The very fact that in this Country these judicial officers are putting this in writing is a reflection of the fascist state we have become! Shameful and shameless…makes me sick to my core!
Forget the employers, our battle is with these corrupt and deficient judicial officers!
